Nous appliquons les crit\u00e8res de justice de Rawls aux statistiques de Piketty sur les in\u00e9galit\u00e9s pour montrer que le capitalisme est injuste, ce qui exige de forger une interpr\u00e9tation projective, r\u00e9ellement applicable, du principe de diff\u00e9rence. Passant de l\u2019\u00e9valuatif au prescriptif, nous proposons un r\u00e9gime alternatif : l\u2019\u00e9quit\u00e9isme, qui place en son c\u0153ur non plus le capital, mais l\u2019\u00e9quit\u00e9. Plut\u00f4t que l\u2019accroissement de la r\u00e9glementation ou de la fiscalit\u00e9, nous pr\u00f4nons une r\u00e9forme en profondeur des institutions organisant la circulation de la richesse (la monnaie), sa production (l\u2019entreprise) et sa transmission (l\u2019h\u00e9ritage). Ligne de cr\u00eate entre libertarianisme et r\u00e9publicanisme, cet institutionnalisme lib\u00e9ral requiert une forme de criticisme juridique distinguant, au sein du droit positif, deux types de dispositions : celles qui transcrivent des droits naturels \u00e0 sanctuariser (propri\u00e9t\u00e9, libert\u00e9 contractuelle) et celles du \u00ab droit positif pur \u00bb que l\u2019\u00c9tat institue souverainement, pour conf\u00e9rer aux agents des droits sur\u00e9rogatoires par rapport aux droits naturels. Cela autorise la mise en place des trois piliers de l\u2019\u00e9quit\u00e9isme : la monnaie libre (d\u00e9sencastr\u00e9e du march\u00e9 de la dette), l\u2019entreprise partenariale (\u00e9mancip\u00e9e de l\u2019actionnariat) et l\u2019h\u00e9ritage universel (lib\u00e9r\u00e9 du cadre lignager).
